Room Chat is a communication channel provided by Trader Oasis LLC. and its affiliates (“Trader Oasis”) as part of the front-end stock and options trading platform known as Trader Oasis (“Platform”). Room Chat provides a platform for communication between an Administrator(s) and/or super Administrator(s) (collectively “admin” or “admins”) and the User. “User” is defined as a subscriber to the Platform and/or an admin’s service or website.
User’s use of the Platform and Room Chat is governed by the Trader Oasis Terms and Conditions and by this disclaimer.
Users who gain access to Room Chat acknowledges that he or she has read the Terms and Conditions and this disclaimer, and that he or she UNDERSTANDS AND AGREES to all of the following terms:
- Trader Oasis and the admin have the sole discretion to provide and discontinue Room Chat to the User.
- Room Chat is used for the purpose of sharing and posting trading information and certain trades that the admin so chooses. In no way do such transmissions and posts of trade ideas, text, pictures, or anything transmitted or posted in Room Chat constitute a recommendation to buy or sell securities.
- A trade posted in Room Chat by an admin may not be an actual trade executed by the admin.
- Trading securities, including, but not limited to, options, stocks, and futures, carry risks and are not suitable for all investors. The User is advised to read the Characteristics and Risks of Standardized Options before investing in options.
- The User uses Room Chat and the information transmitted and posted in Room Chat at his or her sole risk. Any trade and/or information used by the User to make or execute a trade in securities is done so at the User’s sole risk and responsibility.
- Room Chat transmissions and posts may not be accurate and the ultimate responsibility lies with the User for making trading decisions and/or executing trades in securities.
- Trader Oasis and the admins shall have no liability for trading transactions executed by the User.
- Trader Oasis and the admin have the authority to remove the User from Room Chat for any reason. The User is advised that profane language and texts, and any ridicule and/or offensive behavior, will not be tolerated and can result in the User’s removal from Room Chat.
- Room Chat conversations and posts can be saved and are reviewable by representatives, employees, directors, and officers of Trader Oasis and User consents to such use.
- Any communications or other materials made at or through Chat Room by User are public (“User Content”). By displaying, publishing, or otherwise posting any User Content on or through Chat Room, User hereby grants to Trader Oasis a perpetual, irrevocable, non-exclusive, sub-licensable, worldwide, fully-paid, royalty free license to use, modify, publicly perform, publicly display, create derivative works, reproduce, distribute, sublicense, and otherwise exploit, in whole or in part, such User Content without the requirement to make payment to you or to any third party or the need to seek any third party permission.
User represents and warrants that it owns the User Content and otherwise has the right to grant the license set forth herein, and the displaying, publishing or posting of any User Content, and Trader Oasis’s use of the content, does not and will not violate the privacy rights, publicity rights, copyrights, trademark rights, contract rights or any other intellectual property rights or other rights of any person or entity.
